Appealing a CLC Lawyer Licensing Decision
An individual who is dissatisfied with any CLC licensing determination may appeal against the determination.
Where an Individual Licence Determination is made under the requirement of the CLC lawyer Licensing Framework, the applicant may within one month from the date of notification of the CLC’s determination submit an appeal to the Discipline and Appeals Committee under Section 29 (Appeals from decisions of Council in relation to licences) of the Administration of Justice Act 1985.
The Discipline and Appeals Committee is more commonly referred to as the Adjudication Panel (AP Rules) and is an independent body. No Member of the Adjudication Panel is a member of the CLC Council or an employee of the CLC. Wherever possible the applicant making the appeal will be provided with the decision of the Adjudication Panel within 42 days of receipt of the request to appeal. The Adjudication Panel reserves the right to extend this to 90 days where needed.
Recognised Body licences are dependent on there being a valid and current CLC Lawyer Licence of at least one Manager. Therefore, licence decisions for Recognised Bodies are predicated by the granting and maintaining of at least one CLC lawyer Licence.
