Intervention into Peter Mallender - March 10th 2017

Introduction

Because he is unable to attend his practice as a result of illness, the CLC has intervened into the Practice of

Q. Where is the file for my matter?.

Please contact the CLC at clc@clc-uk.org or filerequest@clc-uk.org, or on 0207 250 8465 for any other queries.

Q. Am I obliged to allow your agent to complete the work for me?
A. No, you have the right to appoint another lawyer. If this is your choice you will need to contact a new lawyer and provide them with your instructions. Your new lawyer will then need to contact Hayward Moon, along with your written authority to release the file to them. They can then advise them of their requirements.

Q. Will I have to pay more for the work?
A. These lawyers will honour fee estimates that you agreed with Peter Mallender but if any additional work becomes apparent you may be charged for this additional work. You will be advised in advance if such additional work becomes necessary.
If you decide to instruct another lawyer to complete the work there will be no obligation for them to match the fees that have been estimated by Peter Mallender. You may also be liable to pay the costs for work carried out to date by Peter Mallender.

Q. Peter Mallender acted for me in the past and is holding my deeds – how do I get hold of these?
A. Deeds, as such, no longer exist as the majority of properties are registered electronically at Land Registry. If you need to prove ownership or are selling or re-mortgaging your lawyer will need to obtain up to date copies of the register from the Land Registry in any case.

We will let you know what information we have and any additional information we may need before we are in a position to identify and send the documents to you. Following an intervention it may take some time for us to access archived files and documents, but you request will be actioned as quickly as possible.

 

Intervention into Kathleen A Turner - January 2015

Introduction

Following the discovery of certain breaches of the CLC Code of Conduct, in particular the Accounts Code, the CLC has intervened into the Practice of

If you have money held in Kathleen Turner’s Client Account this will be immediately transferred to either the CLC Intervention Client Account or direct to our agent’s Client Account.

If you decide to instruct another lawyer to complete the work there will be no obligation for them to match the fees that have been estimated by Kathleen Turner. You may also be liable to pay a proportion of the costs for work carried out to date by Kathleen Turner.

Q. I am due to exchange/complete this week – what will happen, will it be delayed?
A. Matters that have already exchanged and are due to complete in the next 10 days will be given priority so that you do not breach the terms of the contract. Hayward Moon will contact you on Wednesday if your transaction is due to complete this week. 
Transactions that have already exchanged but are not due to complete in the next 10 days will also be given priority but it is likely that Hayward Moon will not make contact with you until the week commencing 2 February 2015.
Transactions that have not yet exchanged may be delayed by a few days because of the intervention but everything possible will be done to avoid any such delays.
